Terms of Service

Welcome to DispatchDeck. These Terms of Service ("Terms") govern your use of the DispatchDeck platform, website, and services (collectively, the "Service") operated by DispatchDeck ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

DispatchDeck is a fleet management platform designed for trucking companies and fleet operators. The Service includes:

Dispatch scheduling and job management
Driver and equipment roster management
Driver Vehicle Inspection Reports (DVIR)
Maintenance tracking and work orders
Time and attendance tracking
SMS notifications and mass messaging (requires SMS Pack)
Document storage and compliance tracking

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

You must be at least 18 years old and have the authority to bind your organization to these Terms.

3. Subscription and Payment

Free Trial: New accounts receive a 14-day free trial with full access to features.

Subscription: After the trial, continued use requires a paid subscription. Subscriptions are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

SMS Pack: SMS messaging features require a separate one-time SMS Pack purchase. SMS credits are non-refundable and do not expire.

Refunds: Subscription fees are non-refundable except as required by law. You may cancel at any time, and your access will continue until the end of the current billing period.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Send spam, unsolicited messages, or messages to people who have not consented
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Upload malicious code, viruses, or harmful content
Resell or redistribute the Service without authorization
Use the Service to harass, abuse, or harm others

5. SMS Messaging Terms

If you use our SMS features, you also agree to our SMS Terms and Conditions, which are incorporated into these Terms by reference.

You are responsible for ensuring that all recipients of SMS messages have provided proper consent to receive such messages. You agree to comply with all applicable laws regarding SMS messaging, including the Telephone Consumer Protection Act (TCPA) and carrier requirements.

6. Your Data

You retain ownership of all data you upload to the Service ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely to provide the Service to you.

We will not sell Your Data to third parties. See our Privacy Policy for details on how we handle your information.

7. Intellectual Property

The Service, including its design, features, and content (excluding Your Data), is owned by DispatchDeck and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Third-Party Services

The Service integrates with third-party providers including:

Firebase/Google Cloud: Hosting, database, authentication
Stripe: Payment processing
Twilio: SMS messaging
SendGrid: Email notifications
Google Gemini: AI features

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

We do not guarantee SMS message delivery, as delivery depends on mobile carriers and network conditions beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPATCHDECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless DispatchDeck, its officers, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

12. Termination

You may cancel your account at any time through the Settings page or by contacting us.

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason at our discretion. Upon termination, your right to use the Service ends immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of North Dakota, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Cass County, North Dakota.
